Acceptable Use Policy

This Acceptable Use Policy (this “AUP”) describes material and activities that are not allowed in connection with Customer’s use of Dapple Services. “Dapple Services” includes Dapple’s GPU-as-a-service and other compute, storage, networking, and any platform offerings, together with the associated hardware, firmware, software, APIs, and documentation that Dapple makes available. Dapple reserves the right to take remedial action in connection with content or uses that Dapple determines fall within the scope of this AUP. Customer is responsible for violations of this AUP by anyone using Customer’s account, with or without Customer’s permission or authorization. Customer is also responsible for violations of this AUP by its end users. Customer’s use of Dapple Services to assist another person in an activity that would violate this AUP if performed by the Customer is also a violation of this AUP. Dapple may modify this AUP at any time by posting a revised version on the Dapple websites and/or its Terms of Service (the “TOS”).

Illegal or Abusive Activity or Content

Customer may not use Dapple Services for any unlawful or abusive purpose. Prohibited activities include but are not limited to:

  • Illegal Activities: Any use of Dapple Services to engage in, further, promote, encourage, or obfuscate illegal conduct or activities, including the dissemination of content that has been determined by a court of competent jurisdiction to be unlawful;
  • Fraudulent or Harmful Activities: Engaging in activities that are deceptive or harmful to others, or that would harm Dapple’s operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g., Ponzi and pyramid schemes, phishing, or pharming), deceptively impersonating another person or entity, or engaging in other fraudulent or misleading practices;
  • Unlawful Pornography: Disseminating child pornography or depictions of nudity or sexual activity obtained or disseminated without the consent of those depicted (e.g., “revenge pornography”);
  • Violent, Harassing, or Abusive Content: Content that incites or threatens violence against any person, promotes terrorism, is intended to harass, abuse or invade the privacy of any individual, creates a risk to the physical safety or health of any individual or to public safety or health, or that threatens or encourages harm on the basis of race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, serious disease or disability, or immigration status; and
  • Controlled Substances: Unlawfully selling or distributing controlled substances, including but not limited to any illegal or prescription drugs.

Security Violations

Customer may not use Dapple Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”). Prohibited activities include but are not limited to:

  • Harmful Software: Content, software, or any other technology that may damage, interfere with, surreptitiously intercept, or expropriate any computer system, program, or data, including any viruses, malware, spyware, adware, Trojan horses, worms, or time bombs;
  • Unauthorized Access: Accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System;
  • Violation of Intellectual Property Rights: Using Dapple Services in a manner that violates, infringes on or misappropriates the intellectual property or proprietary rights of any third party, including without limitation any rights in or to copyright, patent, trademark, trade secret, privacy or publicity, and publishing content intended to assist others in unlawfully circumventing technical measures intended to protect any such rights;
  • Interception: Monitoring of data or traffic on a System without permission; and
  • Falsification of Origin: Using fake or misleading TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. This prohibition does not include the use of aliases or anonymous remailers.

Network Abuse

Customer may not make network connections to any users, hosts, or networks unless the Customer has express permission to communicate with them. Prohibited activities include but are not limited to:

  • Monitoring or Crawling: Monitoring or crawling of a System (as defined above) that impairs or disrupts the System being monitored or crawled, or other harvesting or scraping of any content of Dapple Services;
  • Deceitful Actions: Introducing intentionally, knowingly, or recklessly, any virus or other contaminating code into the Dapple Services, or collecting, transmitting, or using information, including email addresses, screen names or other identifiers, by deceit or covert means (such as phishing, Internet scamming, password robbery, spidering, and harvesting);
  • Intentional Interference: Interfering with the proper functioning of any System, including any deliberate attempt to overload a System by mail bombing, news bombing, broadcast attacks, flooding techniques, or conducting a denial of service (“DoS”) attack;
  • Operation of Certain Network Services: Operating open proxies, open mail relays, open recursive domain name servers, Tor exit nodes, or other similar network services;
  • Avoiding System Restrictions: Using manual or electronic means to avoid any use limitations placed on a System, such as access limits and storage restrictions;
  • Retaliation Against Dapple: Any conduct that results in or is likely to result in retaliation against Dapple, including Dapple Services, or Dapple’s employees, officers or other agents, including engaging in behavior that results in or is likely to result in any Dapple server being the target of a DoS attack;
  • Withholding Identity: Any activity intended to withhold or cloak identity or contact information, including the omission, deletion, forgery or misreporting of any transmission or identification information, such as return mailing and IP addresses; and
  • Mining of Cryptocurrencies: Mining, minting, staking, validating, or otherwise participating in the consensus mechanism of any cryptocurrency, blockchain, or distributed ledger, and operating any distributed computing, grid, or compute-sharing network that makes Dapple Services available to persons other than Customer, in each case without Dapple’s explicit prior written permission.
  • Compute Resources and Infrastructure Integrity
  • Dapple Services are delivered on shared and dedicated computing infrastructure, including graphics processing units and other accelerators, high-speed interconnects, host systems, and associated storage. Customer may not use Dapple Services in a manner that degrades, destabilizes, or compromises that infrastructure or the workloads of other customers. Prohibited activities include but are not limited to:
  • Circumvention of Resource Limits: Evading or attempting to evade any quota, allocation, rate limit, tenancy boundary, or scheduling control, including manipulating any job scheduler, orchestration layer, or metering or billing system, or consuming resources outside those allocated to Customer;
  • Multi-Tenancy Violations: Attempting to access, infer, or interfere with the data, memory, workloads, or model artifacts of any other customer, including through side-channel, timing, memory-remanence, or fault-injection techniques, or attempting to escape or bypass any container, virtual machine, or hypervisor boundary;
  • Firmware and Hardware Tampering: Modifying, downgrading, or attempting to modify any firmware, microcode, BIOS, baseboard management controller, device driver, or out-of-band management interface, or physically altering, removing, or interfering with any hardware component;
  • Power and Thermal Abuse: Overclocking, undervolting, or otherwise operating hardware outside the parameters published or permitted by Dapple, disabling or interfering with power capping or thermal management controls, or running workloads designed principally to maximize power draw rather than to perform useful computation;
  • Resale or Sharing of Capacity: Reselling, sublicensing, brokering, time-sharing, or otherwise making Dapple Services or any compute capacity available to any third party, except as expressly permitted in Customer’s agreement with Dapple;
  • Residual Data: Attempting to recover, access, or reconstruct any data, model weights, or configuration remaining on any storage device, host memory, or accelerator memory from any prior allocation; and
  • Benchmarking and Disclosure: Publishing or otherwise disclosing to any third party the results of any benchmark or performance test relating to Dapple Services without Dapple’s prior written consent.

Artificial Intelligence and Automated Systems

By uploading, submitting, or providing any data, materials, or content to our Services, including artificial intelligence offerings and automated systems, you represent that you own or have obtained all necessary licenses, permissions, and consents to do so. You are solely responsible for ensuring that this data, material, or content does not violate any applicable laws (including data privacy regulations) or infringe upon or misappropriate any third-party rights.

Customer is also responsible for the models, agents, and automated systems it trains, fine-tunes, deploys, or operates using Dapple Services and for the outputs they generate. Prohibited activities include but are not limited to:

Synthetic Abusive Content: Developing or operating any model or system whose purpose or predominant use is to generate child sexual abuse material, sexualized depictions of minors, or non-consensual intimate imagery of any person;

Deceptive Synthetic Media: Generating or distributing synthetic audio, images, video, or text that impersonates a real person or organization without that person’s or organization’s consent, or that is intended to deceive as to its artificial origin, including for purposes of fraud, market manipulation, election interference, or organized disinformation;

Weapons and Critical Infrastructure: Developing or operating any model or system intended to provide material uplift in the design, synthesis, or deployment of chemical, biological, radiological, or nuclear weapons, to select or engage targets without meaningful human control, or to operate critical infrastructure or safety-critical systems without appropriate human oversight;

Surveillance and Profiling: Developing or operating biometric identification, emotion inference, predictive policing, or social scoring systems in violation of applicable law or without any consent required by applicable law;

High-Risk Determinations: Using outputs as the sole basis for any decision having a legal or comparably significant effect on an individual, including decisions relating to employment, credit, housing, insurance, education, healthcare, or access to essential services, without meaningful human review; and

Circumvention of Safeguards: Circumventing, disabling, or attempting to defeat any content filter, safety guardrail, usage limit, monitoring, or abuse-detection mechanism implemented by Dapple or by any model provider whose model is made available through Dapple Services.

Vulnerability Testing

The Customer may not attempt to probe, scan, penetrate, or test the vulnerability of a Dapple system or network, or to breach the Dapple security or authentication measures, whether by passive or intrusive techniques, or conduct any security or malware research on or using Dapple Services, without Dapple’s prior written consent.

Export Control and Sanctions Compliance

Dapple Services are provided using advanced computing hardware, software, and technology that are subject to U.S. and other applicable export control and economic sanctions laws. Customer may not use Dapple Services in any manner that would cause Dapple or Customer to violate those laws. Prohibited activities include but are not limited to:

Restricted Parties: Providing, transferring, or otherwise making available access to Dapple Services, or to any compute capacity, model weights, or technical data derived from them, to any person or entity that is the target of economic sanctions or that appears on a restricted party list maintained by the U.S. government or other applicable authority;

Restricted Jurisdictions: Accessing or using Dapple Services from, or making Dapple Services available in, any country or territory subject to a comprehensive U.S. embargo or that is otherwise a prohibited destination for the applicable hardware or technology, and using any proxy, virtual private network, relay, or other means to disguise or misrepresent the jurisdiction from which Dapple Services are accessed or in which workloads are operated;

Prohibited End Uses: Using Dapple Services in connection with the design, development, production, or use of nuclear, chemical, or biological weapons, missile technology, or unmanned systems intended for weapons delivery, or for any military-intelligence end use, in each case where such use is restricted under applicable export control law; and

Compliance Information: Failing to provide, or providing inaccurate or incomplete information in response to, Dapple’s reasonable requests for information regarding the identity of Customer’s users, the jurisdictions from which Dapple Services are accessed, or the end use of Customer’s workloads, where Dapple requires that information for its own export control or sanctions compliance.

Dapple Monitoring and Enforcement

Dapple reserves the right, but has no obligation, to investigate any suspected violation of this AUP or misuse of Dapple Services by the Customer about which Dapple has actual knowledge. In connection with such investigations, Dapple may report any activity that it reasonably suspects may violate any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Such reporting may include disclosing, reviewing and preserving appropriate customer information consistent with applicable law. Dapple may also cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this AUP. Dapple may employ automated tooling to monitor resource utilization, network telemetry, and hardware health and integrity signals for the purposes of detecting violations of this AUP, protecting the security and stability of its infrastructure, and meeting its export control, sanctions, and other legal obligations.

Consequences of Violation of AUP

If Dapple determines, in its good faith discretion, that the Customer has violated this AUP, Dapple may remove, disable access to, or modify any content or resource and/or suspend or terminate Customer’s use of Dapple Services. Dapple may also intercept or block any content or traffic belonging to the Customer or its end users in instances where Dapple Services are being used unlawfully or not in accordance with this AUP. Dapple’s right to suspend or terminate the Customer’s use of Dapple Services applies even if a violation is committed unintentionally or without the Customer’s authorization. Nothing in this AUP may be construed as an obligation on Dapple to act at any given time or with respect to any given instance, and Dapple may exercise such right at any time within its sole discretion. Where Dapple reasonably believes that Customer’s use of Dapple Services presents an imminent threat to the security, stability, or physical integrity of Dapple’s infrastructure, to the workloads or data of other customers, or to Dapple’s compliance with applicable law, Dapple may suspend, throttle, isolate, or terminate the affected workloads immediately and without prior notice, and will use reasonable efforts to notify Customer promptly thereafter.

Reporting of Violations of this AUP

If Customer becomes, or should reasonably become, aware of any suspected violation of this AUP, Customer must notify Dapple by providing a full explanation of the bases for the violation.
